This Privacy Policy governs the manner in which FuelMor, Inc. (referred hereinafter as “FuelMor” or “We”) collects, uses, maintains and discloses information collected from our company tenants (“Tenants”), your customers (“Customers”) and their respective employees and agents ( all of the foregoing Tenants and Customers and their agents/employees are hereinafter referred hereinafter as, individually, a “User” or “You” or “Your” and, collectively, as “Users”) of the www.FuelMor.com website, FuelMor office and enterprise solutions, FuelMor driver(s) applications, tank monitoring applications, mobile applications, truck monitoring applications and related integrations (all of the foregoing collectively “Services” and each a “Service” ). This Privacy Policy applies to all of the Services offered by FuelMor to You or any other User.

Personal Information

We may collect personal information from Users in a variety of ways, including, but not limited to, when Users visit our website, register on the website, subscribe to a newsletter, respond to a survey, fill out a form or in connection with tank utility, purchase our Services, the customer delivery, dispatch and routing services or other activities, features and resources We now or in the future make available through our Services.

Users may be asked for, as appropriate, their name, email address, mailing address, phone number, credit card information, payment methods and banking information. Users may, however, visit our Services anonymously. We will collect personal information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personal information, except that it may prevent them from engaging in certain Services-related activities.

Credit card information will be stored with a third party specialized in the handling of such information, such as a credit card payment gateway or other payment vendors.

Non-Personal Information

We may collect non-personal information about Users whenever they interact with our Services. Non-personal information may include the web browser name, the type of computer and other technical information about the User’s means of connection to our Services, such as the operating system, the internet service providers utilized and other similar information.

Web Browser Cookies

Our Services may use “cookies” to enhance user experience. A User’s web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about them. A User may choose to set their web browser to refuse cookies or to alert them when cookies are being sent. If they do so, note that some parts of the Services may not function properly.

Mobile App Information: What We Collect and How We Use it

When a User downloads our driver app on a mobile device, they have the ability to give access to certain features on their device. In addition, the app will use GPS information from a mobile device to send a driver's location to other Services. Also, We will track a User's location in the foreground and background, as well as track their fine and coarse location. Please note that Users can modify their settings at any time.

How We Protect Users’ Information

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of Users’ personal information, username, password, transaction information and data stored on our Services.

Sensitive and private data exchange between the Services and Users happens over a transport layer security (“TLS”) secured communication channel.

Sharing of Personal Information

We do not sell, trade or rent Users’ personal information to any third party. We may share generic aggregated demographic information not linked to any personal information regarding Users and other website visitors with our business partners, trusted affiliates and advertisers for the purposes outlined above. We may use third-party service providers to help us operate our business and the Services or administer activities on our behalf, such as sending out newsletters or surveys. A User’s banking and credit card information is not stored FuelMor (unless placed by User in the “Notes” section) as soon as typed in the sections are automatically integrated to third party merchant payment processors or affiliated financial institutions that will handle the future transactions in the ordinary course of business.

Children

Our Services are not intended for children under 13 years of age, and We do not knowingly collect personal information (as defined by the U.S. Children’s Online Privacy Protection Act, or “COPPA”) in a manner not permitted by COPPA. If We obtain actual knowledge that any information We collect has been provided by a child under the age of 13, We will delete that information to the extent required by applicable laws.

We do not knowingly “sell,” as that term is defined under the California Consumer Protect Act of 2018 (“CCPA”), the personal information of minors under 16 years old who are California residents.

FuelMor has the discretion to update this Privacy Policy at any time. When We do, We will revise the last updated date at the top of this page. We encourage Users to frequently check this page for any changes to stay informed about how We strive to protect the personal information We collect. You acknowledge and agree that it is your responsibility to review this Privacy Policy periodically and become aware of modifications.

Users’ Acceptance of These Terms

By using these Services, You acknowledge and agree to their acceptance of this Privacy Policy and terms of service. If You do not agree to this policy, please do not use our Services. Your continued use of the Services following the posting of any changes to this policy will be deemed your acceptance of those changes.

We collect and use these categories of personal information for the business purposes described above, including to provide and manage our Services.

If You would like to request the above information or delete your personal information, You can do so by email at Office@FuelMor.com, however it is generally more efficient for Customers to contact the Tenant directly to delete such information. In the request, please specify which right You are seeking to exercise and the scope of the request. We may require specific information from You to help us verify your identity and process your request. If We are unable to verify your identity, We may deny your requests to know or delete. If you are a Customer of a Tenant, you may wish to also contact the Tenant directly to address your concerns and exercise your rights.

Right to Opt-Out

We do not generally sell information as the term “sell” is traditionally understood. However, if and to the extent “sale” under the CCPA is interpreted to include advertising technology activities such as those implemented specifically for interest-based advertising, We will comply with applicable law as to such activity.

Right to Non-Discrimination

You have the right not to receive discriminatory treatment by us for the exercise of any your rights.

Financial Incentives

Financial incentives are programs, benefits, promotions or other offerings for the disclosure, deletion, or sale of personal information about them. We offer a number of promotions and other incentives at any given time, each with their own individual terms. Your intentional participation in any of the promotions or other incentives will be interpreted as affirmative consent to the terms of such incentive.

We generally do not treat Users differently if they exercise a right under California law. However, in certain circumstances, discounted prices or rewards will require You to be part of the particular program. In such circumstances, We may offer a price difference because the price is reasonably related to the value of your data.

If You are a California resident, You may ask FuelMor for a notice describing what categories of personal information FuelMor shares with third parties or affiliates for those third parties or affiliates’ direct marketing purposes and identify the name and address of the third parties that received such personal information. Please submit a written request to the address provided below and specify that You want a copy of your California Shine the Light Notice. We may require additional information from You to allow us to verify your identity and are only required to respond to requests once during any calendar year.
